Lake Saint Louis man charged in shooting of suspected car thief

Felony charges have been filed against a Lake Saint Louis resident involved in the shooting death of a man who may have been trying to steal his car.

Charles L. Flagg, 39, of the first block of Monterey Cypress Lane, was charged Nov. 16 with both second degree murder and an alternative charge of involuntary manslaughter in the first degree. The charges will be presented to a grand jury that will decide what charges to indict Flagg on or not indict him at all.

Flagg was not incarcerated on Wednesday and faces a bail of $100,000. The second degree murder charge suggests, upon conviction, that the defendant was trying to cause serious physical injury and the involuntary manslaughter charge suggests, if guilty, that the defendant recklessly caused a death.

The victim, Shawn T. Jimenez, 31, of Lake Saint Louis was found about 1 a.m. on Nov. 4 on Quail Meadows Court in the driver’s seat of a vehicle taken from Flagg’s townhouse about a block away.  Jimenez was pronounced dead at the scene.

According to a probable cause statement from a Lake Saint Louis Police Department detective, Flagg told police that he woke from a deep sleep to the sound of his automobile alarm going off. He said he looked out his bedroom window and saw a male suspect walking near his car parked in his driveway.

He took a .357 caliber revolver and went outside. He said he heard his alarm again and his car engine started and saw the man sitting in driver’s seat, adding that he was trying to steal the car.

The driver’s window was closed and he yelled for the man to stop. The driver then backed the vehicle in reverse away from Flagg, who pointed his revolver at the windshield and fired one shot.

The man backed out of the driveway toward Lake Saint Louis Boulevard and Flagg said he walked toward the vehicle as it was leaving and fired three to five shots toward the driver’s window.

Police said they received 911 calls including one about 12:51 a.m. from a caller who said someone was trying to steal his vehicle, shots had been fired and requesting assistance.

Jimenez was found in a 2009 Volkswagen Passat, which had rolled off Lake Saint Louis Boulevard into a backyard and against a home on Quail Meadows.

The statement adds that Jimenez was struck with a shot at least once on the left side of his chest.  “At no time did Flagg state he felt threatened or assaulted by S.J [Shawn Jimenez],” according to the probable cause statement.
